Judge in the second court martial had accepted money from the LTTE

Parliamentarian General Sarath Fonseka has in a petition filed before the Court of Appeal stated that one of the judges in the second court martial against him had been in the LTTE payroll.

 

General Fonseka though his petition has sought a writ application to cancel the second court martial against him.

 

The petition states that the current Army Commander, who has also been named as the first respondent, was displeased with General Fonseka for initiating a disciplinary inquiry against the current Army chief when General Fonseka was the head of the Army.

  The petition also states that court martial action was taken against the second respondent, who is the head of the court martial Major General Milinda Peiris, for giving false evidence during an inquiry when General Fonseka was the head of the Army.

 

The third respondent, Major General Davulagala is said to have worked closely with the Defence Secretary for about two years.

 

The petition further states that Major General M. Haturusinghe has had close ties with the LTTE and was in its payroll.

 

It has been said that the appointment of a judge advocate affiliated to the Attorney General’s Department when there was a permanent judge advocate in the military is improper.
