Tribunal to hear General’s petition

The Court of Appeal has decided to appoint a three judge tribunal to inquire into the petition filed by former Commander of the Army and Member of Parliament Gen. Sarath Fonseka against the second court martial against him.

 

 

This order was issued when the petition was taken up today before a panel of judges consisting the President of the Court of Appeal Sathya Hettige and  Niel Gunaratne. 

In the petition filed by Gen. Fonseka Army Commander Jagath Jayasuriya, judges of the second court martial Maj. Gen. W.L. Dalugala, Maj. Gen. M. Hathurusinghe, Maj. Gen. M.P Peiris, rear Admiral W.J.S. Fernando and the Attorney General have been named as respondents. 

In his petition Gen. Fonseka asks the Court to issue an order stopping the judges convening the second court martial and release him from Army detention. A tribunal of three Judges that includes Sathya Hettige, Rohini Marasinghe and Sarath de Abru was appointed and the petition will be taken up on 4th June.
